
In 2005, Congress passed a law that requires individuals to attend a session of credit counseling before filing a bankruptcy petition. Credit counseling is provided by non-profit agencies, approved by the United States Trustee.
In a credit counseling session, a professional counselor will review your financial circumstances and help you determine whether there are reasonable alternatives to filing bankruptcy. Credit counseling sessions are held either in-person, by phone or via internet, depending on the agency. Upon completion of an approved credit counseling session, a certificate will be issued which must be filed with the bankruptcy petition.
